General Terms and Conditions of Business and Participation for GRAVEL RUN Events

**§ 1 General**
The organizer of the GRAVEL RUN events is XLETIX GmbH, Bouchéstraße 12 (Building 8, Staircase B), 12435 Berlin (Local Court Berlin Charlottenburg; registration no. HRB 152510B).
These terms and conditions of business and participation form the basis for participation in GRAVEL RUN events.
All legally effective declarations by participants must be made in text form (email, letter, fax) and addressed directly to XLETIX GmbH.

**§ 2 Participation as an active participant, spectator & volunteer**

**1. Minimum age & other personal data**
To participate actively, the participant must be at least 16 years old. The minimum age may vary depending on the distance and/or event—please refer to the event description on the organizer’s website and the ticketing provider. For the participation of a minor, a declaration of consent from a legal guardian is required. In addition, minors under the age of 16 may only participate when accompanied by a person responsible for their supervision (hereinafter: “accompanying person”). One accompanying person may supervise a maximum of three minors. The accompanying person also participates in the run as a regular participant and must be at least 18 years old on the day of the event. In all cases, the age and identity of each participant (including accompanying persons) must be verified by photo ID during registration at the event location.

If a participant (or accompanying person) provides incorrect age information—regardless of whether this was intended to bypass the minimum age requirement—XLETIX GmbH is entitled to exclude that person from the event. The same applies if the participant (or accompanying person) did not book the ticket themselves, even if they are not responsible for the incorrect age information. Claims of XLETIX GmbH arising from the purchase of a ticket remain unaffected by exclusion due to incorrect age information.

Incorrect or incomplete personal information may, at the discretion of the organizer or authorized persons, lead to exclusion from the event depending on the severity of the misinformation—regardless of whether the participant (or accompanying person) or a third party is responsible. There is generally no minimum age for spectators. If a minimum age is defined for specific events, the same conditions apply to spectators as to participants.

**2. Authority to issue instructions and communication of rules of conduct**
Before and during the event, the organizer and authorized persons may establish and communicate binding rules of conduct for participants and spectators to ensure the proper and safe execution of the event. These instructions must be followed. Violations that endanger the event process or the safety of participants or spectators may result in disqualification or exclusion. Any resulting sanctions are determined on-site at the discretion of the organizer or authorized persons, taking into account the situation, the nature of the violation, and the participant’s understanding.

Participants are required to comply with all applicable mandatory regulations related to participation in the event, particularly those concerning safety and health protection measures for participants and others involved in the event (e.g., specific safety/hygiene concepts such as pandemic-related requirements). Such measures will be communicated by the organizer in advance of the event.

GRAVEL RUN events are intended as a place of encounter and open, tolerant interaction based on democratic and cosmopolitan values. XLETIX GmbH rejects all forms of discrimination and is committed to diversity. Participants and spectators are required to treat each other, the organizer’s staff, and all other persons, facilities, and equipment with respect at all times.

The display of extremist, antisemitic, or otherwise discriminatory ideologies is strictly prohibited. This includes, but is not limited to, expressing or spreading extremist or discriminatory slogans or gestures, insulting individuals based on origin, gender, skin color, religion, or sexual orientation, wearing or carrying related symbols or clothing, and distributing such materials. Violations may result in exclusion from the event and a ban from the premises without compensation or refund of the participation fee.

Participants and spectators must relieve themselves only in designated areas and must not participate under the influence of alcohol or drugs. Violations may result in exclusion from the event at the discretion of the organizer or authorized persons.

**3. Exclusion for medical reasons**
Medical personnel appointed by the organizer are authorized to exclude participants or spectators from the event before or during participation if continuing would pose a risk to life or health.

**4. Vehicles**
Vehicles are not permitted on the event grounds. Where structurally possible, parking areas may be designated; in such cases, participants and spectators may use them in compliance with road traffic regulations.

**5. Advertising**
Active and passive advertising (e.g., banners, flyers, specially designed clothing, calls, chants, or “guerrilla actions”) is only permitted with prior written approval from the organizer. Violations may result in exclusion from the event. The organizer reserves the right to pursue any resulting claims, particularly under competition law. The same applies to any alteration, defacement, or manipulation of advertising approved or placed by XLETIX GmbH, especially on clothing or race numbers.

**§ 3 Special features of participation tickets & refund of ticket prices**
Registration is completed online via a designated form or portal. Registrations by fax or email are not accepted. Registration (offer) becomes effective only upon confirmation by the organizer (acceptance).

Participation tickets are personal and non-transferable. Transfers to another person require approval by the organizer and can only be carried out online. The organizer may charge a fee for such changes.

Refunds of ticket prices (including optional products, bus tickets, and accommodation) are generally excluded in the event of non-participation, even if this is communicated in advance.

If an event is canceled without replacement, the organizer is obligated to refund the ticket price. In cases of force majeure (e.g., weather), official orders, or other factors beyond the organizer’s control that may affect safety or health, the organizer may postpone, cancel, or modify the event. In such cases, the organizer is exempt from any liability for damages.

There is no right of withdrawal for consumers. Contracts for services related to leisure activities are excluded from the statutory right of withdrawal if the contract specifies a fixed date or period (§ 312g (2) sentence 1 no. 9 BGB). Therefore, orders for event tickets are binding immediately upon confirmation by XLETIX GmbH and obligate the purchaser to accept and pay for the tickets.

**§ 4 Final provisions**
By participating, I accept these terms and conditions. Should individual provisions of this agreement be invalid, void, or unenforceable, the validity of the remaining provisions shall remain unaffected.

XLETIX GmbH reserves the right to amend these general terms and conditions and other provisions (e.g., liability agreements). Changes will only be made for valid reasons, such as technical developments, changes in legal rulings, or comparable circumstances (e.g., updated hygiene regulations). Changes will be limited strictly to what is necessary to address these circumstances. If a change significantly disrupts the contractual balance between the parties, it will not be made. Otherwise, changes require the consent of the customer.
